APPEAL PROCESS

The State of Missouri mandates a state-wide reassessment every two years. The Assessor's office must estimate the market value of your real estate and notify you of that value. This value is the basis for the calculation for your annual property tax bill. If you have a dispute with the assessor concerning the market value, there is a three step process that can be followed in an attempt to remedy the situation.

INFORMAL APPEAL - this step occurs immediately following notification, typically in March or April. It is the most casual of the three steps, in which you meet personally with a member of the assessor's staff to correct any errors that might have occurred during the data collection stage and discuss possible revisions in your valuation.

BOARD OF EQUALIZATION - this is a three-member panel. This board meets during the months of June and July. The purpose of the board is to hear disputes between the assessor and the taxpayer and render a decision. The deadline to file an appeal with the board of equalization is the third Monday in June. These are filed through the Franklin County Assessor's Office.

STATE TAX COMMISSION - this is the most difficult phase of the appeal process. At this level, narrative appraisals and attorneys are needed for commercial property, while substantial valuation evidence is required for residential property. A hearing officer, assigned by the state tax commission will hear the appeal in Franklin County and decide the case based on the evidence submitted. It is important to remember that you must have filed an appeal with the B.O.E. in order to be eligible for this step. The deadline for filing an appeal with the tax commission is august 15 or thirty (30) days following your B.O.E. decision.
