Permit Application Instructions

 

General Info:

 

Fireworks Sales will be permitted in Franklin County from June 20th to July 10th.  Applications must be submitted by June 1st to allow time for the necessary inspections.  A separate permit is required for each stand and must be obtained each year.

 

 

Application:

 

The following items must be submitted with the application:

 

  • A fee of $200.00 for each fireworks stand location

 

  • A statement that the applicant agrees to comply with all applicable state and local laws and regulations

 

  • Proof of Franklin County Business License

 

  • A cash deposit, irrevocable letter of credit, or surety bond in the amount of $3,000 to guarantee that the site will be cleaned and restored after the stand is no longer in operation (only required during the 1st through 5th years of operation with a permit)

 

  • A site plan showing the following:

Ø  site location,

Ø  size of the lot and tent,

Ø  location of the tent, storage units, trailers, signs, and any other structures  on the site,

Ø  location of driveway entrances and parking lot areas with identification of the surface material of parking lots and driveways,

Ø  location and number of parking spaces,

Ø  location of restroom facilities

Ø  location of dumpsters,

Ø  location of nearest fire hydrant 

 

·         Proof of valid Missouri State sales tax number

 

·         Approval of driveway entrance from MoDOT if entrance is on state right of way or approval from Franklin County Highway Department if entrance is on county right of way

 

 

Procedures:

 

Review by the Planning and Zoning Department

Applications with all the required information should be submitted to the Planning and Zoning office.  Planning and Zoning will check that all the required materials have been received and that the zoning and site plan meets the regulations.

 

Planning and Zoning will check the following items:

 

Prior to June 20th

 

  All required materials have been submitted

 

  Site plan meets requirements (dumpsters, parking spaces, restroom facilities, etc.)

 

 

After the fireworks stand has opened

 

  No more than two semi truck storage trailers (or the equivalent) are located on the site. 

 

  Parking surface is adequate to serve the vehicular and foot traffic on the site

 

  No portion of county-owned right-of-way is affected by parking area

 

  Signage meets the regulations for fireworks stand signage, reflects what was shown on the site plan, and does not block site distance

 

  Premises is free of trash and debris

 

  Employees are not flagging vehicles or otherwise obstructing the flow of traffic

After July 15th

 

  Site has been restored and cleaned to its original condition

Review by the Building Department

The Building Department will approve the structure and site used for the fireworks stand prior to opening.

 

The Building Department will check the following items:

 

  Structure meets the required _____ foot setback for the ____________ zoning district.

 

  Actual site reflects what was proposed on the site plan.

 

  Parking lot is paved or surfaced with material that is stable and will help to reduce dust and erosion. 

Surface material __________________________

 

  Structure complies with the ICC Building Code relative to Temporary Structures and is safe and approved for use as a commercial structure.

 

  Each outlet has at least two exits.  All exits will open without a key or other special effort or knowledge.

 

  Stand shall have no less than two fire extinguishers, one of which must be a 2A rated water-pressure type fire extinguisher.  Such extinguishers are in good working order and easily accessible.

 

  Flame retardant certificate is located on tent or other location on the site

 

  Restroom facilities on site

 

  “No Smoking” signs posted (at least 2)

 

  Approval from local fire department

 

  Permit from Missouri State Fire Marshal

 

  Fireworks Building Permit posted on site
